The ongoing months-long divorce battle between Ben Foster and Laura Prepon shows no signs of slowing down, with both parties airing their grievances in court.
On January 21, 2025, exclusive legal documents obtained by In Touch Weekly magazine revealed Ben’s latest accusations against his ex-wife. Foster claims that Laura refused to negotiate a custody agreement for their two minor children.
Filed just days before the ex-couple reached a temporary custody arrangement on January 10, 2025, the documents were submitted by Ben’s attorney, Rose Palermo.
In them, Palermo accuses Laura of character defamation and of exerting toxic control over their family dynamic post-split. She wrote,
“[Laura’s] decision to engage in a direct character attack on [Ben] in her response is perfectly illustrative of [Laura’s] compulsion to seize and maintain control over every aspect of family life, regardless of who it hurts”.

Moreover, the attorney alleges that the That ’70s Show star has crafted a false public image of herself, putting herself in a positive light at Foster’s expense. The documents state,
“[Laura] has demonstrated an obsession with presenting a false public image of herself… by painting [Ben] in a completely false light and trying to damage the children’s relationship with their father”.

Laura Prepon Refuses Ben Foster’s Request To See Their Children
In the filing, the X Men: The Last Stand star accused Laura of denying his requests to spend time with their children, asserting that she claimed such visits would disrupt their routine and negatively impact the kids.
Ben’s lawyer responded to these claims, writing,
“The only person upset by pivoting plans is [Laura] who self-admittedly struggles with her obsessive need for control. While pivoting children’s schedules can certainly be a challenge, it does not detract from the experience of cherished time with their loving father”.
However, just days after this heated legal dispute, Ben and Laura reached a temporary custody agreement, which was approved by the court.
The arrangement grants Ben regular parenting time with both their daughter and son, with a strict clause included. The official court order states:
“Neither party shall consume alcohol to the point of intoxication while around the minor children during his or her parenting time”.
After six years of marriage, Foster filed for divorce on November 12, 2024, citing ‘irreconcilable differences’ and noting that the couple had been separated since September 2023.
Their divorce proceedings are still ongoing, with the court yet to issue a final ruling.
